From 1 May 2010, the implementation of the two new regulations for the coordination of social security systems - Basic Regulation (EC) No. 883/2004 (BR) and Implementing Regulation (EC) No. 987/2009 (IR). These two regulations replace the old regulations for the co-ordination of social security systems in force until 30 April 2010 - the old Basic Regulation (EEC) No. 1408/71 and the old Implementing Regulation (EEC) No. 574/72.

Regulation (EEC) No 1408/71 and its Implementing Regulation - No 574/74 maintained their effect with regard to the countries of the European Economic Area (EEA) Agreement - Iceland, Norway, Liechtenstein - until 31.03.2012, and in relations with Switzerland - until 31.05.2012.

The new regulations on the coordination of social security systems have become applicable to the EEA countries - from 01.06.2012 and to Switzerland from 01.04.2012.
  1. Scope of application (Personal scope) of BR № 883/04: - all citizens of a Member State (MS) of the EU;
  • all nationals of an EU Member State (MS);
  • stateless persons and refugees residing in a Member State who are or have been subject to the legislation of one or more MS;
  • family members and descendants of the above categories of persons.
 
  1. Types of benefits (material scope) of BR № 883/04:
  • benefits for sickness, maternity benefits and their equivalent of parental child care benefits (benefits in kind);
  • old-age, disability, survivors' benefits (benefits in cash);
  • benefits for accidents at work and occupational diseases (benefits in kind and benefits in cash);
  • pre-retirement benefits (benefits in kind and benefits in cash);
  • unemployment benefits (benefits in cash);
  • family benefits (benefits in case);
  • death grants (benefits in cash).
 
  1. Applicable law - The main provisions of applicable law in Regulation (EEC) No 1408/71 have been complied with. Features on posting - up to 24 months, without extension.

As of 1 May 2010, all EU F forms replaced by the old regulations have been replaced for EU countries. The old forms for certification of health insurance rights and for the right to medical assistance when moving to another EU country are replaced by new forms of the S (Sickness) series, DA1 = E123 *

The new form for certification of applicable legislation issued by the NRA is Al (Applicable legislation).

E-forms issued under the old regulations remain valid until their expiry date. E-forms with term until canceled" are valid until changes in the circumstances concerning the relevant insured persons. **

The EHIC and the CTR of the EHIC issued under the old regulations remain valid until their expiry date or until the circumstances surrounding the insured persons change. Pursuant to Decisions No. S 1 and No. S2 of the Administrative Commission for the Coordination of Social Security Systems (AC), the type, content of the European Health Insurance Card (EHIC) and the Certificate of temporary replacement of the EHIC (CTR EHIC) remain unchanged.
 
FOR ALL CATEGORIES OF PERSONS, THE EHIC AND THE CTR EHIC are issued by THE COUNTRY IN WHICH THE PERSONS ARE INSURED.
* Until 1 May 2014, old Type E forms may remain in circulation and should be recognized by EU Member States.
** It is expected that after 01.05.2014 the competent insurance institutions will switch to the exchange of information on the insured persons from paper to electronic version - with Structured Electronic Documents (SEDs).
